Workshop Offerings:

The CLSA is proud to offer the following workshops in conjunction with the 2013 Convention in Sacramento, California. Pre-Convention workshops begin Sunday morning, October 13, 2013 at 9:00 a.m. and end Monday, October 14, 2013 at 12:00 p.m.

  • W1. Delicts Against the Faith and Sacraments Reserved to the CDF
    • Presented by Very Rev. Daniel A. Smilanic and Rev. Paul L. Golden, CM
      • This workshop will treat both the substantive and the procedural norms of Sacramentorum sanctitatis tutela except the delicts treated in article 6. It will focus on issues and questions of interest to those who instruct, adjudicate and serve as advocates in these cases. Through lecture, discussion and case studies, the following topics will be covered: constitutive elements of each delict, imputability, right of defense, prescription, preliminary investigation, standard of proof, relevant elements of the judicial and the extra-judicial processes and recourse.
  • W2. Choosing an Appropriate Ground of Marriage Nullity
    • Presented by Dr. Lynda Robitaille
      • Procedural law envisages that a person work with an advocate to present a marriage nullity case to a Tribunal. Thus, from the beginning the case highlights specific grounds of invalidity. In practice, however, this is rarely the case. The petitioner often presents a case without any understanding of why the marriage might be invalid. The Tribunal must determine from the person’s marriage history what grounds might be applicable. In the words of a Rotal auditor, "Defining the wrong grounds may be fatal to the outcome, in first instance, and may be irreparable on appeal. Personnel assisting in identifying the grounds must therefore be no less highly qualified than the judges themselves, and keep up on (Rotal and local) jurisprudence.” This workshop will address how to identify grounds at the beginning of the process, keeping in mind the realities of possible proofs available in relation to proofs required.
